National system of qualifications"},"content":{"rendered":"<p>On June 17, 2022, the Law of Ukraine No. <a href=\"https:\/\/zakon.rada.gov.ua\/go\/2179-IX\" target=\"_blank\" rel=\"noopener\">2179-IX<\/a>\u00a0of 01.04.2022\u00a0 \u201cOn amending some Ukrainian legislation on functioning of the national qualifications system\u201d came into force. The law was published in the <a href=\"http:\/\/www.golos.com.ua\/edition_archive\" target=\"_blank\" rel=\"noopener\">Holos Ukrayiny<\/a> issue <a href=\"http:\/\/www.golos.com.ua\/files\/preview\/2022\/06\/160622.jpg\" target=\"_blank\" rel=\"noopener\">No. 124<\/a>\u00a0of 16.06.2022.<\/p>\n<p>The law amends the Labor Code and laws \u201cOn labor remuneration,\u201d \u201cOn education,\u201d \u201cOn employment\u201d in terms of:<br \/>\n\u2022 definition of complete and partial professional qualification;<br \/>\n\u2022 setting priority of professional standards over qualification characteristics;<br \/>\n\u2022 some issues of development, approval, and enactment of professional standards;<br \/>\n\u2022 setting up and keeping a register of occupations (professions) and qualifications;<br \/>\nprovisions of sectoral councils on developing the professional standards, some relevant legislative provisions on functions of the collegial body in the qualifications field, and other related issues.<\/p>\n<p>In particular, the <a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/322-08\" target=\"_blank\" rel=\"noopener\">Labor Code of Ukraine\u00a0<\/a>is complemented with a new Article 4<sup>2 <\/sup>(Professional Standards) that reads:<\/p>\n<p><em>\u00a0\u00a0\u00a0\u00a0\u00a0&#8220;Professional standard is duly approved requirements for competencies of employees, which are basis for forming professional qualifications.<br \/>\n<\/em><em>\u00a0\u00a0\u00a0\u00a0\u00a0Professional standards can be developed by employers, their organizations and associations, governmental authorities, scientific institutions, sectoral councils, public unions, and other interested actors.<br \/>\n<\/em><em>\u00a0\u00a0\u00a0\u00a0\u00a0Professional standards are approved by their authors.<br \/>\n<\/em><em>\u00a0\u00a0\u00a0\u00a0\u00a0If a professional standard is not developed by a sectoral council for developing professional standards, it is approved after coordination with a representative all-Ukrainian association of trade unions at a sectoral level.<br \/>\n<\/em>\u00a0\u00a0\u00a0\u00a0\u00a0<a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/373-2017-%D0%BF#Text\" target=\"_blank\" rel=\"noopener\"><em>The Procedure of development, enactment and review and professional standards<\/em><\/a> <em>is approved by the Cabinet of Ministers at the request of the National Qualifications Agency.<br \/>\n<\/em>\u00a0\u00a0\u00a0\u00a0\u00a0<a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/z0784-17#Text\" target=\"_blank\" rel=\"noopener\"><em>The Procedure of development and approval of qualification characteristics<\/em><\/a><em>\u00a0 is approved by a central executive authority that ensures formation of the state policy in the field of labor, labor relationships and employment of the population at the request of the National Qualifications Agency.<br \/>\n<\/em><em>\u00a0\u00a0\u00a0\u00a0\u00a0Requirements for competencies, duties, and qualifications of employees are determined by professional standards. If professional standards are absent, such requirements can be determined by qualification characteristics.<br \/>\n<\/em><em>\u00a0\u00a0\u00a0\u00a0\u00a0Methodical recommendations for developing the professional standards are prepared by the National Qualifications Agency and are published on its official website.&#8221;<\/em><\/p>\n<p>The law is aimed at settling some aspects of developing, approving, and enacting the professional standards, which will allow forming modern requirements for expertise and competencies of employees and promote higher employment rate.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On June 17, 2022, the Law of Ukraine No. 2179-IX\u00a0of 01.04.2022\u00a0 \u201cOn amending some Ukrainian legislation on functioning of the national qualifications system\u201d came into force.
